Terms & Conditions 4YOUSKITEAM Engadin Sagl
General provisions and scope
Unless otherwise agreed, these Terms and Conditions apply to all business transactions between 4YOUSKITEAM Engadin Sagl and its customers. The commercial purpose of the company is the operation of a sports school in the snow, by bike and in the mountains. This includes services such as giving lessons regarding skills and knowledge of snow sports and mountain outdoor activities without guarantee of a certain training success, as well as driving and accompanying activities during winter and summer sports. Ski instructors, snowboards, cross-country skiing, mountain guides, hiking guides and cycling guides are referred to below as “course instructors”. For reasons of legibility, the male form is used when referring to people, but the female form is always included.
Reservation
By booking, the customer accepts the conditions as an integral part of the contract between them and 4YOUSKITEAM Engadin Sagl. Any wishes and concerns regarding food, medical, etc. must be communicated directly to the course instructor in advance before the start of the activity (at least 48 hours in advance), so that the course instructor can take appropriate measures.
Pricing
Prices are shown in Swiss francs. For payments in Euro or other foreign currencies, the corresponding current exchange rate of the service provider will be applied. Unless otherwise specified in the detailed description of the offer, the price includes the cost of the lesson, course or package. Prices do not include personal catering, equipment rental and transport costs to/ from the mountain (cable cars, taxis or public transport).
Payment terms
The total amount of the agreed service is due 48 hours before the start of the activity and is confirmed only upon receipt of payment. In case of delay in payment, there is no right to carrying out the activity.
Cancellation or modification of reservations by the customer
Cancellations must be made in writing to info@4youskiteam.com at least 48 hours before the start of the activity. In case of cancellations made later by the customer, the full rate of the reservation will be charged. Each class or group course that is started will be charged in full, regardless of whether it should be terminated prematurely.
You are not entitled to reimbursement if:
the activity cannot be carried out for delay or lack of presentation of the customer;
the customer starts a business only after its scheduled start or leaves it before the end;
the customer does not use certain (half) days in case of multi-day bookings (even in case of group lessons for children).
Cancellation or modification of bookings by 4YOUSKITEAM Engadin Sagl prior to the start of business
4YOUSKITEAM Engadin Sagl reserves the right to modify or cancel the programme or individual services, even at short notice, after the conclusion of the contract, in the event of natural and/ or meteorological conditions or other unforeseeable circumstances (force majeure, official measures imposed or other risks) make this necessary. The refund will be made in the form of a voucher.
Program change or activity cancellation after or within 48 hours before the activity starts
4YOUSKITEAM Engadin SAGL reserves the right to modify the programme of activities or some of the agreed services if external circumstances (e.g. force majeure, weather and natural conditions, officially imposed measures or safety risks) make this necessary.
In case of the following events, the customer will be reimbursed for the payments made by deducting the costs already incurred:
closure of tourist service providers such as mountain railways, trains, hotels or restaurants due to official measures (e.g. pandemic).
In the case of:
closure of tourist service providers such as mountain railways, public transport (trains, buses, etc.), hotels, restaurants and equipment rental shops due to weather or natural conditions (e.g. official severe weather warnings.)
illness or accident or any other incapacity of the client.
Group lessons
Tickets for group lessons are not transferable. Group lessons are held with a minimum of four participants per skill level. In the event of fewer participants, 4YOUSKITEAM Engadin SAGL reserves the right to combine classes with different skill levels at short notice, to move them to another location, to shorten or cancel lessons. Lunch tickets can only be refunded on the same day.
Passivity
4YOUSKITEAM Engadin Sagl expressly excludes any liability for incidents during lessons and competitions or for any claim of liability in relation to the services provided by 4YOUSKITEAM Engadin Sagl. No claims (for damages) can be made on the basis of errors in the illustrations, prices and texts.
Insurance
The insurance (health and accident insurance incl. sports accidents, etc.) is paid by the participant. It is recommended that customers take out insurance for cancellation and repatriation costs.
Vindication
Any claims or damages must be notified in writing to 4YOUSKITEAM Engadin Sagl at info@4youskiteam.com within four weeks of the end of the activity. All claims will be void in the event of a claim made later.
Confidentiality of data
4YOUSKITEAM Engadin SAGL reserves the right to use the image material of all services provided for marketing purposes. Your consent to the use and disclosure of data and images may be revoked at any time by contacting us at info@4youskiteam.com. The data necessary for the processing of commercial transactions are treated confidentially.
Place of jurisdiction
4YOUSKITEAM Engadin Sagl operates exclusively under the provisions of the Swiss Code of Obligations and as the sole place of jurisdiction of the Maloja Regional Court.
